Copyright Policy

Welcome to Pop My Mind.

This Copyright Policy governs the rights granted to You each time You upload a piece of creative content to The Platform.

In a nutshell,

  • Other Users are free to sample, adapt, transform, modify, alter or build upon Your work for non-commercial purposes only so long as they credit you for use of your content.
  • You maintain all other rights associated with your content

Please read the below Copyright Policy carefully before uploading any Content to The Platform.

1. Definitions

In this Copyright Policy the words and expressions have the same meaning as those contained in Our Site Terms

2. The Rights granted to Users

Upon uploading Your Content to The Platform, You grant the following rights to Users on a worldwide, royalty free, fully paid-up basis:

a) The non-exclusive right to adapt Your Content by remixing, transforming, modifying or altering Your content in such a way that shows clear distinction between Your Content and the Derivative Content, subject to the conditions stated in section 3 of this agreement.

b) The non-exclusive right to build upon Your Content by adding original audio, text, images or moving images to Your content in such a way that shows that significant creative value has been added to Your Content, subject to the conditions stated in section 3 of this agreement.

c) The non-exclusive right to copy and reproduce Your Content for the sole purpose of creating Derivative Content, subject to the conditions stated in section 3 of this agreement.

3. Conditions on the rights granted to Users

Users are granted the rights stated in section 2 of this agreement subject to the complete fulfilment of the following conditions...

a) Users must only publish, perform, display, broadcast and otherwise exploit Derivative Content for non-commercial purposes only i.e.  no commercial advantage or monetary compensation can be sought by Users in relation to exploiting Derivative Content.

b) You warrant that Your Content or Derivative Content does not infringe any copyright, database right or trade mark of any other person.

c) Users must provide an appropriate credit for use of Your Content when publishing, performing, displaying or broadcasting Derivative Content.

By appropriate credit We specifically mean adhering to all of the following requirements.

1. For online publishing of Derivative Content, Users must credit Your Username within the content description of the Derivative Content.

2. For offline publishing of Derivative Content, Users must credit Your Username within an area that is visible to any viewer or listener of the Derivative Content.

4. The Rights granted to Visitors

Each time You upload Your Content to The Platform You grant a non-exclusive, worldwide, royalty free, fully paid-up license to Visitors of The Platform to look at, watch, read and listen to Your Content via The Platform.

Visitors are not permitted to download, copy, reproduce, authorise derivatives or  publically perform, display or broadcast Your Content for any purpose.

5. The rights granted to POP MY MIND

Each time You upload Your Content to The Platform You grant a non-exclusive, worldwide, royalty free, fully paid-up license for POP MY MIND to publish Your Content on POP MY MIND's social media channels, which explicitly include Facebook, Twitter and Tumblr. 

This right is granted to Us on the condition that We credit Your Username within the publishing of Your Content on POP MY MIND's social media channels.

6. Additional Rights

POP MY MIND will approach selected Users with opportunities to monetise their Content and showcase their Content at exhibitions. Any such opportunities are offered on an opt-in bases whereby We must obtain written consent from selected Users in order to peruse any such activity that requires the grant of any additional of rights further to the rights stated in sections 2, 4 and 5 of this agreement.

7. Term and termination

The rights granted in sections 2, 4 and 5 of this agreement apply for the complete period of time in which Your Content is hosted on The Platform. 
If You wish to remove Your Content from The Platform please contact Us in writing. POP MY MIND reserves the right to take up to 28 days to remove Your Content from The Platform upon receiving Your request.

If You fail to comply with all of the terms this Copyright Policy, then the rights granted to You under this Policy shall terminate immediately.

8. Breach of terms

Please contact us if you believe that any party has breached any terms of this Copyright Policy.

Pop My Mind reserves the right to remove Your Content from The Platform with immediate effect if We deem it to be in breach of any terms of this Copyright Policy.

9. Disclaimer

Whilst Pop My Mind endeavours to take appropriate action against breaches of this Copyright Policy, We make no promises or guarantees that any action will be taken by Us in relation to any breach made by any party of this Copyright Policy.

10. Indemnity

You hereby agree to indemnify Us from and against any and all claims, obligations, damages, losses, expenses, and costs, including reasonable attorneys' fees, resulting from:

a) Users violating any terms of this Copyright Policy

b) Visitors violating any terms of this Copyright Policy

c) You violating any terms of this Copyright Policy

d) Any claim made by a third party in relation to an infringement of copyright arising from the hosting of Your Content on The Platform

11. Law and Jurisdiction

This Copyright Policy is governed and construed in accordance with English law, and any disputes relating to this Copyright Policy will be subject to the exclusive jurisdiction of the Courts of England and Wales.

12. Changes and updates

We reserve the right to change and update this Copyright Policy at any time.

13. Agreement

You must only upload Your Content to The Platform if and only if You agree to the entire contents of this Copyright Policy.

If You do not agree to the terms of this Copyright Policy in full then You must not upload, store or transmit any audio, text, images, videos or any other content, data or information via The Platform.
